The terms and conditions define how a service contract between VulkanoStudio and its customers is implemented.

Interpretation of these terms and conditions:

Acceptance of these terms and conditions by the customer:

These terms and conditions are visible from any page of the company’s website, and the customer must read them carefully. 

From the moment the customer accepts a quote from the company, he admits that he has read and accepted these terms and conditions, without having to sign them, as the link to these terms appears on all quotations.

Vulkanostudio reserves the right to add, delete or modify any provision of these terms and conditions at any time without notice. 

Failure to receive notification of a change in these terms and conditions does not invalidate that change.

Payment of Services to Vulkanostudio:

All prices provided by Vulkanostudio are exclusive of VAT unless otherwise specified.

The price of the services provided by Vulkanostudio is defined in the quote that the customer receives by email. 

The budgets issued by Vulkanostudio are valid for a period of 30 days unless otherwise indicated. 

After that period, the company reserves the right to alter the budget for the same services.

Vulkanostudio reserves the right to alter the budget if the customer proposes any changes or for reasons it deems appropriate, and in any case, A quotation has no contractual value until Vulkanostudio. The customer formalizes the start of the project by paying the first invoice.

Unless otherwise agreed with the customer, Vulkanostudio will charge in advance 50% of the total price of the project commissioned by the customer. 

The remaining 50% will be paid in two parts by the client and at the end of the project, the company will deliver the files for the migration. 

Vulkanostudio will not start any project until the client has paid the initial 50% and will not deliver the files of any project until it has received the payment of the final 50%.

In the case of periodic services, such as SEM campaigns or SEO maintenance, Vulkanostudio will charge the first month in advance and then at the end of each month, unless Vulkanostudio and the client agree otherwise.

Payment for services will be made by bank transfer, which the customer will send to Vulkanostudio by email.

Delivery Dates:

Vulkanostudio will agree with the customer the delivery times before acceptance of the budget and undertakes to respect them to the fullest.

For its part, the customer agrees to provide the contents of the website (text, images, videos, graphics, sound files) at the time of making the initial bank transfer with 50% of the total project price in advance.

Requirements to Install the Web:

If the client requires his web to be installed on a server of his choice, he agrees to provide the company with temporary access to his hosting via FTP. 

Depending on the specific nature of the project, Vulkanostudio may also require client access to other server resources.

The development of the project, until it is completed, will be done on a test server owned by Vulkanostudio. The client will have access to your web site on the test server to review changes to your project.

All Vulkanostudio web projects include migration to hosting once the project is finished, as long as the latter is a Linux hosting with MySQL databases in the companies Cdmon, 1and1, Arsys, Digital Ocean or Wetopi. For migrations, to other hostings, the company reserves the right to invoice the time spent on studying its control panel.

Once the web is migrated, the maintenance of the hosting will be in charge of the client, unless he contracts web maintenance with the company (see section “Maintenance of the web once delivered”). 

Vulkanostudio does not work in any case with non-Linux hostings since they do not work optimally with WordPress websites.

AdWords or Facebook Ads Account Management:

To ensure that you can make the most of your client’s click-through budget with the greatest freedom, Vulkanostudio manages client advertising accounts from your own user account, to which you have unique access. 

If the client expressly wishes Vulkanostudio to design their advertising campaign from their user account or have shared access to that account, the contracting of the service will imply an initial payment of 499 pounds for the design of the campaign and a minimum permanence of 6 months.

Copyright of the Contents:

If you do not contract Vulkanostudio to produce content, you agree to provide unpublished material, which is your property. 

Vulkanostudio reserves the right to ask the customer for documentary evidence of authorship of the text, photos and videos, and in no case use in the development of the web project material that is not owned by the customer.

In any case, the customer is responsible for the copyright of the material used on its website to possible requirements of the relevant authorities and keep the company unharmed of potential claims by third parties due to negligence or inability to obtain the copyright of the contents.

Compliance with the LOPD:

The client is responsible for ensuring that their website complies with the Organic Law on Data Protection. Vulkanostudio, upon request, within the price of all projects, will include a legal notice page and a privacy policy page accessible from the bottom of the web, whose texts must be provided by the client, who will be responsible for their compliance with current legislation.

Revisions of Changes:

Unless otherwise agreed between Vulkanostudio and the client, the client will be entitled to two revisions of changes to their web project. 

These revisions will involve small modifications (typographies, photographs, inclusion or exclusion of elements, etc.), not substantial changes of design. 

(changes in the structure of the website, the layout of sections, additional programming of web functions, etc.) or substantial revisions of content (text, images, etc.).

It is Vulkanostudio who will assess the scope of the requested changes and inform the client if they imply a new dedication that requires an extension of the budget. 

If the client requests a substantial revision, the company will quote the changes requested and add them to the overall budget, so that the client can pay for them at the end of the project.

In the case of SEM campaigns, the client will be able to review the performance of their campaign periodically, when Vulkanostudio delivers its quarterly report, or with the periodicity agreed upon by both parties. 

The client can propose changes in the campaign, which must be accepted by the company. Vulkanostudio reserves the right not to apply the changes requested by the customer in SEM campaigns if it sees that these may affect their good performance. 

In return, Vulkanostudio is committed to achieving a higher conversion rate than would be performed by another professional or by managing the customer’s campaign.

In SEO maintenance campaigns with content marketing, the client can review the monthly post written by the company’s professionals for their blog and correcting mistakes, never proposing substantial modifications to the post, which would require the payment of two posts. 

It is necessary to keep in mind that each content marketing professional has his or her own style that the client cannot change.

No Feedback From The Client:

Vulkanostudio is a business that needs to be efficient in order to be competitive. To achieve this, you must ensure that scheduled projects are carried out on time. Sometimes the company may even have to reject requests for quotes and projects to ensure that ongoing projects are delivered on time.

Vulkanostudio will not start any project if it does not have the content well classified and ready for inclusion on the web in advance, unless otherwise agreed with the client or the client has contracted the content provision services from the company. 

Clients who contract an SEO strategy for their web projects, for example, should bear in mind that it is essential to deliver the content in advance to be able to plan the web structure and review the most appropriate keywords for better positioning in search engines.

If at the beginning of the project the client has committed to Vulkanostudio to provide content, and it takes more than a week from this time to do so Vulkanostudio reserves the right to close the project and not to refund the initial transfer of 50% of the total amount.

If during the development of the project, the customer incurs in continuous delays of more than a week in delivering missing content or reviewing changes, Vulkanostudio reserves the right to impose a 5% surcharge on the final project price for each week of delay. 

If the client continues to incur delays, Vulkanostudio reserves the right to unilaterally terminate the project, deliver it in a file in its current state and bill the client for all work done to date.

In short, the customer must ensure that at the time of starting your web project is prepared to provide everything that Vulkanostudio needs to efficiently provide its services or, otherwise, do not commit to the company until it is.

Excessive Customer Feedback:

The client accepts that Vulkanostudio has several projects underway and therefore, cannot provide ongoing feedback beyond the specific needs that may arise during the project.

On the other hand, the client accepts that, in order to be competitive in terms of price and quality, the company cannot meet in person unless the quotation includes meetings or agrees otherwise with the client. 

Vulkanostudio prioritizes emails as a means of communication with the client. If the client requires any additional meeting in the middle of the project, Vulkanostudio reserves the right to extend the budget to include the time spent on the meeting or to change it to a Skype call or similar, which would also be included in the final budget if it is not possible to attend due to scheduling issues.

Cancellation of a Project:

The client has the right to cancel a project, provided that it is done in writing. Vulkanostudio will issue an invoice for the amount of work done up to the date of the notification which must be paid by the client before the end of the same month.

Operation of the websites on different devices and browsers Vulkanostudio undertakes to adapt the web projects to the main devices and most used browsers (Firefox, Internet Explorer in its latest versions, Google Chrome, etc.), But cannot guarantee the operation of all web functionalities with browsers that have certain extensions and work with certain types of operating systems. 

The client accepts this condition, as well as the fact that the company is not responsible for the subsequent adaptation of the page to new versions of browsers and devices, reserving the right to quote separately. 

The client also accepts that the company does not physically have all the devices on the market to test its websites directly and that it uses simulators, which may on very rare occasions not coincide 100% with the display of the device in question.

Management of the website or online store:

Vulkanostudio delivers websites and online stores that are easy to self-manage. However, the client accepts that he must have basic knowledge of WordPress (text management, adding or deleting pages and menus, etc.) o WooCommerce (text management, prices, coupons and promotions; adding or removing products, etc.) In case the client needs screenshots or tutorials of any kind, written or on video, the company will quote it separately.

The customer accepts that self-managed concepts do not include those that may cause a mismatch of the design, such as sizes, colours and fonts, measurement of images, footer, proportions of the sections, etc. 

Vulkanostudio is not responsible for the mismatch of the design by the changes made from the code or those made through the self-managed modules that do not respect the initial configuration, for example, of changes of photos by others with different measures or proportions, of texts longer or shorter than those present in the initial version, among others.

On the other hand, the client accepts that the projects do not include specific plugins for web analytics, data or stock management, invoicing, taxation or others that do not come by default with WordPress or WooCommerce unless otherwise agreed with the company.

Maintenance of the Website Once Delivered:

Vulkanostudio delivers to the customer a correctly functioning website, which the customer must check at the time of delivery. 

The needs of any type that arise to the customer for its web after delivery will be budgeted separately and will be carried out according to the availability of the company, including those that have an urgent nature (webserver crashes, slow loading, database viruses or others) and those of a periodic nature (adaptations of the web to new versions of browsers or devices, plugin and software updates, etc.)

This concept also includes updating the web content manager (WordPress or similar), the plugins used or the resolution of errors that the customer has made when modifying their website or any other type, contact with the client’s hosting provider in case of a problem or any need that arises after the delivery, testing of payments or sending of forms or any concept derived from the operation and maintenance of the website, including advice.

In the event that the client contracts web maintenance services with Vulkanostudio, he has the right to have the company solve the mentioned needs according to the conditions of the service he has contracted, excluding substantial modifications to the website, which are not included in any form of web maintenance (see specific conditions for each service). 

Vulkanostudio reserves the right to quote separately for modifications resulting from a manipulation of the code by the client or the incompatibility of a new version of WordPress or any other CMS with functionalities initially programmed to measure, for being alien to the will of the company, although it has contracted the service of web maintenance.

Maintenance of the Domain and Hosting:

Vulkanostudio will place the domains that the client needs to buy in the name of the client, who will be responsible for paying the annual fee by credit card or any other form of payment.

If the customer contracts web maintenance services to Vulkanostudio, which are associated with the hosting offered by Vulkanostudio, you will not have to assume additional costs because the price of hosting is included in the web maintenance fee.

If you want to cancel the web maintenance service with Vulkanostudio, the customer must first migrate your web to another hosting of your choice; you can not keep the one provided by the company since the two services are linked contractually. 

In the event that the migration to the new hosting is required by Vulkanostudio, Vulkanostudio will quote the migration separately.

Web Development Credits:

The client’s website will not contain any reference to Vulkanostudio. However, the client agrees that the company will include its website in its portfolio.
